Monster Speech Terms of Service

Welcome to Monster Speech. These Terms of Service ("Terms") govern your access to and use of the Monster Speech website, platform, and interactive games (collectively, the "Service"). By creating an account, paying for a subscription, or using the Service, you agree to be bound by these Terms.
1. Description of Service
Monster Speech provides a software-as-a-service (SaaS) platform featuring interactive digital games and avatar mechanics designed to be used by Speech-Language Pathologists (SLPs), educators, and clinicians as a supplemental engagement tool during therapy sessions.
2. Clinical and Educational Disclaimer
Monster Speech is a digital engagement tool, not a medical device, diagnostic tool, or guaranteed therapeutic treatment.
- No Replacement for Professional Judgment: The Service is intended to support, not replace, the professional judgment, diagnosis, and treatment plan of a licensed SLP or healthcare provider.
- No Guarantee of Outcomes: We make no claims or guarantees regarding clinical outcomes, speech progress, or developmental milestones resulting from the use of our platform.
3. Account Licenses and Sharing
Your Monster Speech subscription grants you a personal, non-exclusive, non-transferable, and revocable license to use the Service.
- Individual Use: Each subscription is licensed to a single, specific professional.
- No Account Sharing: You may not share your login credentials, password, or active session link with other therapists, educators, or across an entire clinic or school district. Clinics or districts requiring multiple users must purchase individual seats for each practitioner.
- Account Termination: We reserve the right to monitor active sessions and IP addresses. We may suspend or terminate your account without a refund if we detect unauthorized credential sharing or abuse.
4. Children's Privacy and User Consent (COPPA & FERPA)
Monster Speech is designed to be operated by a professional adult while a minor participates. We do not market directly to children or expect children to create accounts.
- Your Responsibility: As the clinician, educator, or institutional representative, you are strictly responsible for obtaining all necessary and legally required consents from parents or legal guardians before allowing a minor to interact with the Service.
- Compliance:You represent and warrant that your use of the Service complies with all applicable local, state, and federal privacy laws, including the Children's Online Privacy Protection Act (COPPA), the Family Educational Rights and Privacy Act (FERPA), and the Health Insurance Portability and Accountability Act (HIPAA), where applicable.
5. Intellectual Property and Third-Party Assets
The structure, organization, code, game mechanics, and unique compilations of the Service are the intellectual property of Monster Speech.
- Proprietary Platform: We own all rights, title, and interest in the software platform, including proprietary source code, user interface designs, custom CSS animations, game rules, brand assets, and logos.
- Third-Party Media & Licenses: Certain visual assets, character elements, and audio effects utilized within the platform are licensed or sourced from third-party creators under open, royalty-free, or creative commons licenses. Ownership of those individual third-party assets remains with their respective creators and licensors.
- Extraction & Scraping Prohibited: Your subscription grants access to experience these elements as a compiled application only. You may not scrape, extract, reverse-engineer, decompile, redistribute, or reuse the underlying code, graphics, or audio files outside of the Monster Speech platform.
6. Billing, Cancellation, and Refunds
Subscriptions are billed in advance on a recurring monthly or annual basis via our payment processor, Stripe.
- Cancellations: You may cancel your subscription at any time through your dashboard. Cancellation will take effect at the end of your current billing cycle.
- No Prorated Refunds: We do not offer prorated refunds for partial months or unused time upon cancellation.
7. Service Modifications and Availability
We are continuously actively developing and expanding Monster Speech.
- Modifications: We reserve the right to modify, add, rebalance, or remove features, games, and mechanics at any time without prior notice or liability.
- Uptime:While we strive for high reliability, the Service is provided on an "as is" and "as available" basis. We do not guarantee that the platform will be uninterrupted or completely error-free.
8. Limitation of Liability
To the maximum extent permitted by law, Monster Speech and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Service, even if we have been advised of the possibility of such damages.
